By downloading, installing, or using FocusXP ("the App", "the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a binding agreement between you and FocusXP ("we", "us", "our"). They apply to all users of the App, including free users and Pro subscribers.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use FocusXP on any Apple device that you own or control, solely for your personal, non-commercial purposes.
This license does not include the right to:
Creating an account is optional. You may use FocusXP as a guest with full access to all free features. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@focusxp.site of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account that occurs before you notify us.
You may delete your account at any time from Settings → Profile → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms.
FocusXP Pro is available as an auto-renewing subscription through the Apple App Store:
Prices are displayed in the App and on the App Store listing at time of purchase. Prices are in USD and may vary by region based on Apple's pricing tiers.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
You can manage and cancel your subscription at any time through your Apple ID Account Settings:
Cancellation takes effect at the end of the current billing period — you retain Pro access until that date.
We may offer free trials of FocusXP Pro from time to time. If a free trial is offered, details (duration, conditions) will be disclosed at the time of the offer. Unused portions of a free trial period are forfeited when you purchase a Pro subscription.
All payments are processed by Apple through the App Store. Refund requests must be submitted to Apple directly:
We do not process refunds directly. Apple's refund policy applies to all purchases made through the App Store.
We reserve the right to change subscription prices. Apple will notify you of any price changes before they take effect, and your continued subscription after the change constitutes acceptance of the new price.
Pro features are available as long as your subscription is active. If your subscription lapses, Pro features will be disabled, but your data (XP, session history, stats) will be preserved. You can re-subscribe at any time to regain access.
You agree not to use FocusXP to:
FocusXP and all related content — including but not limited to the name, logo, design, UI, audio tracks, and code — are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any part of FocusXP without our express written permission.
FocusXP does not host user-generated public content. Any data you enter (display name, project tags, session notes) is stored locally on your device and/or synced to your private account. You retain ownership of your personal data. By using cloud sync, you grant us a limited license to store and process that data solely to provide the Service to you.

FocusXP is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
You use FocusXP at your own risk. The App is not a medical or therapeutic product and should not be used as a substitute for professional advice.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising out of or relating to your use of FocusXP, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of FocusXP shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless FocusXP and its affiliates, officers, agents, and employees from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.
We may suspend or terminate your access to FocusXP at any time, with or without cause or notice, if we believe you have violated these Terms. Upon termination:
These Terms are governed by and construed in accordance with the laws of the European Union, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the EU member state in which we operate.
As FocusXP is distributed through the Apple App Store, the following additional terms apply:
We may modify these Terms at any time. We will notify you of significant changes via the App or email (if you have an account). The updated Terms will be posted at focusxp.site/terms.html with an updated "Last updated" date. Your continued use of FocusXP after changes constitutes acceptance of the revised Terms.
